"Access to justice and collective litigation within the EU"

The US class action mechanism is an important part in providing access to justice to claimants in the US. It can also be an efficient collective litigation mechanism for the resolution of mass claims. This presentation looks at the European perspective for mass claims. It takes the recent developments at an EU level in respect of collective litigation as the context for examining the development of mechanisms for resolving mass disputes in UK and Germany. The presentation will reflect on whether existing collective redress procedures provide sufficient and effective access to justice for a wide range of citizens, particularly consumers, who wish to bring collective claims.
